DCFS Wants Me to Sign a Safety Plan in Los Angeles. Do I Have To?

Mohammad Abuershaid

No court order requires you to sign a voluntary safety plan. But refusing can have consequences, so do not sign or refuse in a panic. A DCFS safety plan is a written agreement that a social worker proposes during an investigation, and it can change who lives in your home and who may be alone with your children.

What these plans usually ask for

  • One parent leaves the home for a period of time.
  • A relative or friend supervises all contact with the children.
  • A parent agrees to drug testing, counseling, or classes.
  • The children stay somewhere else “for now.”

Why “voluntary” can feel anything but

A worker may suggest that the alternative is removal. Sometimes that is an honest prediction. Sometimes it is pressure in a case that would not meet the legal standard for removal under Welfare and Institutions Code section 306. A refusal may also be noted in the file and cited later if the department goes to court. Parents are often asked to decide on the spot, before they have seen the evidence.

Questions to ask before signing

  • What exact concern is this plan meant to address?
  • How long does it last, and what ends it?
  • What happens if the supervising relative becomes unavailable?
  • Will this be shared with police or used in my family court case?
  • Can I take a copy and have my attorney review it today?

A plan can be open-ended if you let it. Ask for an end date and specific conditions in writing.

How the plan can hurt you later

Agreeing to move out can be cited by the other parent in custody litigation. A signed plan may read like an admission even if it says otherwise. Breaking its terms can become the reason the department seeks court action. On the other hand, a narrow, carefully negotiated plan can sometimes keep a family out of court altogether.

How a lawyer helps

An attorney can often speak with the worker the same day, narrow the terms, add an end date, and suggest safeguards that meet the actual concern. See our guide to DCFS investigations and juvenile dependency in Los Angeles.

Frequently asked questions

Is a DCFS safety plan legally binding?

It is generally not a court order, but violating it can lead DCFS to seek court involvement or removal.

Can I change my mind after signing?

You can ask to end or change a plan, but do it through counsel because the department may respond by going to court.

Can DCFS make me move out of my home?

Without a court order, DCFS cannot order you out, but it may request that you leave as part of a safety plan and may act if you decline.
